1    About these terms
These terms and conditions govern your access to and use of the preventative health assessment services (Services) offered by Qscan Group and its related entities (Qscan). By submitting a booking request, you confirm that you have read and understood these Terms and agree to be bound by them. If you do not agree, you must not proceed with the Services. 


2    Eligibility
You are eligible to access the Services if you are at least 18 years of age, are not pregnant and you successfully complete and pass Qscan’s initial screening questionnaire. You do not need to have an identified health concern to access the Services, however a valid referral from your doctor is required to request and complete a booking. Obtaining a referral remains subject to your doctor’s clinical judgement and discretion. 


3    Booking Process
To request a booking, you must submit a booking request via Qscan’s website and upload your referral. A Qscan booking agent will contact you by phone after your request to discuss your eligibility, confirm the proposed examination(s), offer available appointment times, inform you of applicable fees for the Services and accept payment of a deposit. Your booking is not secured until the deposit is received. 


Qscan may require additional information (including MRI safety screening details) prior to confirming an appointment. If you do not provide any requested information within the timeframe specified by Qscan, your booking request may be cancelled. 


Qscan may decline, suspend, or cancel a booking if you do not meet the eligibility criteria, if any safety concern arises, or if Qscan considers the Services are not suitable for you due to the presence of certain implants, devices, metal fragments or other conditions. 


4    Payment
Qscan will inform you of the applicable fees for the Services before confirming your appointment. Services are not eligible for Medicare rebates and may not be covered by private health insurance. You are responsible for paying all amounts not covered by Medicare or any insurer.


A deposit is payable by phone at the time of booking and the remaining balance is payable at the time of your appointment. Qscan accepts payment by cash, EFT or credit card. 


5    Cancellations, Rescheduling, and No-Shows
You may cancel or reschedule your appointment by contacting Qscan during business hours more than 2 business days prior to your scheduled appointment. If you:
(a)    cancel less than 2 business days before the scheduled appointment time; or
(b)    do not attend your appointment (no-show),
your deposit will be forfeited.


Rescheduling within 2 business days of the appointment time or arriving more than 15 minutes after your scheduled appointment time may be treated as a cancellation or no-show at Qscan’s reasonable discretion.
 

Qscan may cancel or reschedule an appointment due to clinical, operational, safety, or technical reasons. If Qscan cancels an appointment and is unable to offer a reasonable alternative time, Qscan will refund your deposit. Qscan is not liable for any costs or losses you incur due to cancellation or rescheduling, except to the extent required by law.


6    Attendance and Preparation
Prior to using the Services you must complete a safety questionnaire and consent form and comply with any required examination preparation notified by QScan (such as fasting requirements). It is important that you disclose all relevant medical and surgical history, implanted devices, medications, allergies, and any relevant prior imaging or test results, for your safety and to assist with the performance and outcomes of the Services.

 
7    Nature of the Services 
The Services are preventative in nature and may be undertaken in the absence of symptoms or identified health concerns. The purpose of the Services is to assist in the early detection of potential health issues. Participating in the Services is a personal choice which should be made in consultation with your doctor. It is important to be aware that:
(a)    the Services are aimed at identifying possible concerns that may require a more detailed examination but are not designed to diagnose specific diseases or conditions. A radiology report is an interpretive opinion based on the images obtained and is not a clinical diagnosis;
(b)    the Services may not detect all conditions. There is a risk of false positives (abnormalities detected which are actually harmless) and false negatives (a scan missing something that is actually present). Some findings may be incidental and of uncertain significance, which could lead to emotional distress or unnecessary intervention; 
(c)    any findings, whether serious or not, may be viewed by insurers as pre-existing conditions. This could affect your ability to take out new forms of insurance or change your existing insurance terms or premiums; and
(d)    the Services are supplementary to your regular medical check-ups and are not a substitute for medical advice, assessment, or ongoing care from a qualified medical practitioner.


Qscan will communicate the results of your examinations to your referring doctor and/or relevant healthcare provider. You must consult with your doctor to discuss your results, obtain clinical advice, and determine any follow-up. You must not rely on the imaging or report as your sole source of medical information or as a basis for self-diagnosis or self-treatment.


8    No Medical Advice
Nothing in the Services, reports, website content, or communications from Qscan constitutes medical or health advice. Qscan does not provide medical consultations or treatment plans as part of these Services. You must seek advice from your doctor or another appropriately qualified healthcare professional regarding any questions about your health, symptoms, screening suitability, or the interpretation and implications of results.


9    Your Obligations and Warranties
You warrant that all information you provide to Qscan is true, accurate, complete, and not misleading, including information provided in your referral, screening questionnaires, and any medical history. You must promptly inform Qscan of any change to your health status, pregnancy status, or other information that may affect eligibility or safety. You must always follow all reasonable instructions of Qscan staff and clinicians while attending a Qscan site.


10    Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded, restricted, or modified by agreement. To the extent permitted by law:
(a)    Qscan excludes all warranties, representations, conditions, and guarantees not expressly set out in these Terms, including as to completeness, accuracy, or fitness for a particular purpose;
(b)    Qscan is not liable for any indirect, incidental, special, punitive, or consequential loss, or any loss of profit, revenue, goodwill, or opportunity; and
(c)    Qscan’s total aggregate liability arising out of or in connection with the Services or these Terms is limited to the amount you paid to Qscan for the relevant Service.


11    Force Majeure
Qscan is not liable for any delay or failure to perform caused by events beyond its reasonable control, including but not limited to unavailability of personnel or equipment, power or network outages, industrial disputes, severe weather, disasters, or public health events. In such circumstances, Qscan will reschedule your appointment or cancel and refund your deposit. 


12    Privacy and Communications
Qscan handles personal and health information in accordance with the Qscan Privacy Policy, which explains how Qscan collects, uses, discloses, and stores personal information (including health information and sensitive information), your rights to access and correct information, and how to make a privacy complaint. 


By using the Services, you acknowledge and consent to Qscan’s handling of your personal information as described in that policy, including disclosures to your referring doctor and other healthcare providers involved in your care, and to third-party service providers that support Qscan’s operations (which may be located in Australia or overseas, as described in the policy).


Qscan also shares deidentified healthcare data with third parties for a range of purposes (which may include the use of AI tools). These purposes are outlined in Qscan’s patient consent form. Data used for these purposes will not include information that directly identifies you. 


You consent to Qscan contacting you by phone, SMS, email, or other electronic means for appointment scheduling, reminders, communications about your imaging, billing, and other administrative purposes. You may update your contact preferences by notifying Qscan through the contact details on Qscan’s website. 


13    Intellectual Property
All content on Qscan’s website and any materials provided to you in connection with the Services (excluding your personal information and health records) are owned by or licensed to Qscan and are protected by intellectual property laws. You must not reproduce, adapt, publish, or communicate such content except as permitted by law or with Qscan’s prior written consent. 


14    Website Use
Your use of Qscan’s website, including any referral upload portals and online forms, must be lawful. You must not introduce viruses or malicious code, attempt to gain unauthorized access, or interfere with the website’s operation. Qscan may suspend or restrict access to maintain security or perform maintenance. 


15    Changes to these Terms
Qscan may update these Terms from time to time. The updated Terms will apply to any booking or use of the Services after they are published on Qscan’s website. If a change materially affects an existing confirmed appointment, Qscan will take reasonable steps to notify you. 


16    Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision is severed to the extent of the invalidity, and the remaining provisions continue in full force and effect.


17    Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them.
